			<content:encoded><![CDATA[<p>The Morristown Town Council unanimously approved the Speedwell Redevelopment Plan last evening.  This plan calls for the development of  650 new housing units and 40,000 square feet of retail space over three phases.</p>
<p>The first phase of the project calls for the redeveloper to construct 268 housing units on a Morristown DPW property off of early street.  10% of those units will be set aside as affordable housing.</p>
<p>The Plan authorizes the use of eminent domain on any of the properties within the designated redevelopment area, although it remains to be seen if the condemnation process will, in fact, be utilized.  Area residents and businesses may also be entitled to relocation assistance in the event that they are displaced.</p>

			<content:encoded><![CDATA[<p>Morristown Patch <a href="http://morristown.patch.com/articles/final-speedwell-redevelopment-agreement-to-be-voted-on-jan-12#c">reports</a> that the Town Council will vote on an Amended Speedwell Avenue Redevelopment Plan on January 12, 2012.</p>

<p>As noted in the Patch article, its been a long-time coming.  The redevelopment initiative for the Speedwell Avenue area began in the early 2000s with an actual &#8220;in need of redevelopment&#8221; designation occurring for a portion of the area around 2004.  The full text of the Speedwell Avenue &#8211; Final Amended and Restated Redevelopment Agreement may be viewed on the Town of Morristown website <a href="http://www.townofmorristown.org/index.asp?Type=B_BASIC&amp;SEC=%7B63EC8E7A-2FDB-48BF-93A0-6C5AF04FE06F%7D">here</a>.</p>
<p>Several businesses in that general vicinity have continued to thrive during the period in question &#8211; Martys Reliable Cycle Center, Rago Brothers, Community Options and others.  We&#8217;re interested to see if the Town&#8217;s &#8220;redevelopment&#8221; efforts attract new businesses to the area.</p>

			<content:encoded><![CDATA[<p>As <a href="http://http://www.app.com/apps/pbcs.dll/article?AID=2011312270048">reported</a> in the <em>Asbury Park Press</em>, the Matawan-Aberdeen train station redevelopment area &#8211; first designated 10 years ago &#8211; is being sent back to the planning board to determine whether the area is still &#8220;in need of redevelopment.&#8221;  As referenced in the article, the municipality is addressing the area now because of changes in State law as to what constitutes a redevelopment area.</p>
<p>The significant change in the State law occurred in 2008, when the New Jersey Supreme Court issued the <em>Gallenthin v. Borough of Paulsboro</em> decision.   The Court signaled to all municipalities in the State that designations based on an overly broad reading of criteria &#8220;e&#8221; (that allowed merely underutilized areas to be deemed in need of redevelopment) did not satisfy the Constitution&#8217;s requirement of blight.  Without the predicate finding of constitutional blight, operation of the redevelopment laws and concomitant tax and zoning benefits  are not allowed.  In addition, the power of eminent domain would be lost if there is a determination that the area is not a blighted area.</p>
<p>We&#8217;ll be interested to see if the Planning Board recommends a continued blight declaration after evaluating the area in light of <em>Gallenthin</em>.</p>

<p>Edward McKirdy and Harry Riskin, <a href="http://mckirdyriskin.com/">McKirdy &amp; Riskin</a>&#8216;s founding partners, recently attended the <a href="http://www.bkconference.com/bkc/home">Brigham-Kanner Property Rights Conference</a> in Beijing, China.  The annual conference, which focuses on the interplay of civil rights and property rights, brought legal scholars, jurists, and practitioners from the United States and China together at <a href="http://www.tsinghua.edu.cn/publish/then/">Tsinghua University</a> in <a href="http://maps.google.com/maps?q=beijing+china&amp;hl=en&amp;ll=39.899202,116.449585&amp;spn=0.981908,2.469177&amp;hnear=Beijing,+China&amp;t=h&amp;z=9&amp;vpsrc=6">Beijing</a> to discuss and debate the global evolution of property rights.  During the conference retired <a href="http://www.law.cornell.edu/supct/justices/oconnor.bio.html">United States Supreme Court Justice Sandra Day O’Connor</a> was awarded the 2011 Brigham-Kanner Prize.  In her acceptance remarks, Justice O&#8217;Connor discussed the United States’ history of property rights protections, China’s emerging laws, and her own property rights decisions.</p>

			<content:encoded><![CDATA[<p>As reported by <a href="http://www.multihousingnews.com/news/todays-deals-cbre-secures-47-5m-for-n-j-adaptive-reuse-project/1004046209.html">Multi-Housing News.com</a>, CBRE secured construction $47.5 million in financing from US Bank to proceed with The Parkway Lofts at Watsessing Station, a 361-unit to-be-built redevelopment project located in Bloomfield, N.J.  The construction will utilize an existing warehouse and the adaptive reuse will maintain existing signature design elements like the 15 foot high quilt-paneled windows.  This structure is adjacent to and visible from the Garden State Parkway.   The second phase of the project calls for 150 town homes to be built.</p>

			<content:encoded><![CDATA[<p>Harrison Township in Gloucester County NJ has a new redevelopment area .  As reported by the <a title="Harrison Township Names Areas in Need of Redevelopment" href="http://www.nj.com/gloucester-county/index.ssf/2011/12/harrison_township_names_areas.html">Gloucester County Times</a>, the area was designated in need of redevelopment in order to make PILOTs (Payments In Lieu Of Taxes) and other incentives available to the putative developer of the property who originally intended to construct single family residential dwellings on the property.  The area, officially known as Block 59, lots 12-14 and 17, is on the north side of Mill Road and Mullica Hill Road (Route 322), near Mill Pond.  In light of the current housing market, the municipality and the developer apparently are working together to see some development occur at this site.</p>
<p>Designation as an area in need of redevelopment means that the municipality now has at its disposal the constitutional right to clear or redevelop the &#8220;blighted&#8221; or &#8220;redevelopment area.&#8221;  The municipality also has the statutory  right to prepare a redevelopment plan and then select a redeveloper who may or may not be the current owner of the property.  Thereafter, the municipality may also exercise its power of eminent domain to take the private property.</p>
<p>We&#8217;ll see how their cooperative efforts progress.</p>

			<content:encoded><![CDATA[<p>As <a href="http://www.northjersey.com/news/135365988_Fort_Lee_is_seeking_feedback_for_redevelopment_resolution.html">reported</a> on NJ.com The Fort Lee Borough Council recently adopted a resolution scheduling a special meeting for December 22, 2011 to discuss whether to amend the Area 5 Redevelopment Plan in order to incorporate land owned by the Cosmos retailer as well as three parcels owned by the Borough.  It is unclear whether &#8211; absent agreement with the property owner &#8211; the Borough will authorize use of eminent domain to acquire the privately held land.</p>
<p>According to a Ft. Lee Patch <a href="http://fortlee.patch.com/articles/mayor-and-council-to-hold-special-meeting-on-amending-redevelopment-5-plan">article</a>, the &#8220;properties are identified on the Tax Map of the Borough of Fort Lee as Block 4851, Lots 2, 3, and 4; a portion of Block 4855, Lot 2 and lands within the street right-of-way that were vacated by the realignment of Central Road with Federspiel Street as part of the Main Street widening project.&#8221; The properties are sometimes referred to as the &#8220;Centuria&#8221; or &#8220;Helmsley&#8221; property.</p>

			<content:encoded><![CDATA[<p>The <em>Daily Times</em> of Delaware County, Pennsylvania <a href="http://http://delcotimes.com/articles/2011/12/05/news/doc4edccfaa66434921850336.txt?viewmode=fullstory">reports</a> that hundreds turned out to protest the announcement of a taking of &#8220;Ludwig&#8217;s Corner&#8221; horse show property from a local cooperative that has operated the site for the last 68 years.  The president of the Ludwig&#8217;s Corner Horse Show Association &#8211; John Jacobs &#8211; complained; “Whatever happened to property rights? It’s just really upsetting to all of us.”  Jacobs also doubts whether the government will continue with the annual horse show after the taking, even though the government is paying lip service to that notion now.</p>
<p>Apparently the government wants to take the 33 acre parcel in order to &#8221;fulfill the vision of its Ludwig’s Corner Strategic Vision and Community Design Plan for a compact, walkable, traditional village center containing a blend of municipal, commercial and residential uses.” In addition, active and passive recreation is planned for the parcel.</p>
<p>Anyone taking a look at the horse association&#8217;s <a href="http://http://www.ludwigshorseshow.org/">web site</a> home page will see a large red banner exclaiming: &#8220;<strong>ATTENTION: HORSE SHOW IN JEOPARDY!</strong>&#8221; The website also notes that there was a Board of Supervisors meeting last night (12/5).</p>
<p>Sounds like there will be a future court case challenging the government&#8217;s use of eminent domain &#8211; we&#8217;ll keep you posted.</p>

<p>As reported by Donna Weaver in this <em>Press of Atlantic City</em> <a href="http://http://www.pressofatlanticcity.com/news/press/ocean/harvey-cedars-paid-to-homeowners-last-month-over-beach-fill/article_1b7a6472-0b3c-11e1-b6ad-001cc4c002e0.html">article</a>, beachfront property owners in Harvey Cedars have recently been paid constitutional <strong><em>just compensation</em></strong> for the taking of their private property rights &#8212; private beachfront &#8211; by the government.</p>
<p>Harvey Cedars is located on Long Beach Island.  As part of a beach replenishment project designed to provide a benefit to all shore visitors, the municipality needed to take property from the owners of beach-front homes.  Given the necessity of the takings, the New Jersey Constitution mandates payment of just compensation.  Some of the cases have been resolved without the necessity of jury trials, but as noted in the cited article, a jury recently awarded a property owner a substantial sum for the taking of their private property.</p>
<p>Local officials in the <em>Press</em> article complain about the payments made to the property owners, but should bear in mind that these owners did not ask for their property rights to be taken, and are constitutionally guaranteed to receive just compensation.</p>
<p><em>McKirdy &amp; Riskin&#8217;s Tom Olson and Jeff Lewis acted as special condemnation counsel to John and Eileen Troast, who own one of the beachfront properties featured in the <span style="text-decoration:underline;">Press</span> article. </em></p>
